sleepvantage is a membership program by ResMed Pty Ltd (ResMed) for customers who purchase ResMed products within Australia and New Zealand via an authorised dealer or ResMed store. sleepvantage membership is only open to residents of these countries.
To become a member you must register your ResMed products online https://www.sleepvantage.com.au/register including providing a proof of purchase and/or a valid serial number of a ResMed product where applicable. ResMed may refuse your application for membership for any reason.
sleepvantage members are entitled to additional sleepvantage product warranties, product support and general sleep therapy advice and customer service. A complete list of benefits is listed on https://www.sleepvantage.com.au/membership-benefits. ResMed may change, improve or withdraw the benefits offered at any time.
Applying for membership constitutes acceptance of these Terms and Conditions. These Terms and Conditions incorporate the ResMed Privacy Policy. By becoming a member, you agree and acknowledge that information about your ResMed account, including personal information you provide to ResMed, is subject to ResMed’s Privacy Policy which can be viewed at www.sleepvantage.com.au/privacy-policy or provided on request.
A condition of your membership is that you will provide ResMed with information concerning your use of its products, therapy and purchase history. This information will be used to provide you with improved customer service, maintain your product warranty records, and so you can receive marketing offers and product information most appropriate to your needs via email, SMS, telephone or mail.
You may also be invited to participate in research relating to product use, lifestyle and other areas of interest relating to your experiences as a user of sleep therapy and services. This information will be used by ResMed to improve our product and service offerings.
Should you wish to opt-out from receiving either product marketing communications and/or research participation invitations, you can do so at any time by contacting our sleepvantage customer service team directly (see Contact Information) or by selecting the unsubscribe option on our communications and updating your preferences. Please note you may still receive communication from ResMed regarding important product or service notifications that may impact the delivery of your therapy.
You may request to terminate your membership at any time by contacting the sleepvantage customer service team (see Contact Information). Any entitlement to an additional warranty as a member will cease and revert to the standard manufacturer’s warranty and your rights under the Australian Consumer Law.
ResMed may terminate membership at any time for any reason, including if application details or product registration details are fraudulent.
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
The sleepvantage membership warranty is an additional 3 year warranty on your ResMed therapy device* and a 50% extension of the standard manufacturer’s warranty on all ResMed masks and accessories that are registered through https://www.sleepvantage.com.au/. All warranty benefits are in addition to any consumer rights you may be entitled to at law.
* ResMed devices include AirMini™, AirSense™ 10, AirCurve™ 10 and Lumis™ devices.
This warranty is only available to the original purchaser. It is not transferrable. If the product fails under conditions of normal use, and none of your statutory rights or remedies apply, ResMed will repair or replace, at its option and at its own cost, the defective product or any of its components.
This warranty will not cover:
(a) any damage caused as a result of improper use, abuse, modification or alteration of the product;
(b) repairs carried out by any service organisation that has not been expressly authorised by ResMed to perform such repairs;
(c) any damage or contamination due to cigarette, pipe, cigar or other smoke, and;
(d) any damage caused by exposure to ozone, activated oxygen or other gasses.
This warranty against defects referred to above is provided to you in addition to the rights and remedies that you have under the Australian Consumer Law (and any other applicable law). The additional warranties set out above are provided by ResMed Pty Ltd ABN 30003765142 of 1 Elizabeth Macarthur Drive, BELLA VISTA NSW 2153. In order to make a claim under this warranty you should contact the ResMed authorised dealer or ResMed store from which you purchased your ResMed product(s) or alternatively send your claim to ResMed at 1 Elizabeth Macarthur Drive, BELLA VISTA NSW 2153. You will then need to deliver the ResMed product you claim is defective to the ResMed authorised dealer from which you purchased your ResMed product or your closest ResMed authorised dealer at your expense. A similar product will normally be lent to you by your ResMed authorised dealer while your product is assessed. The product you claim as defective must be delivered from the ResMed authorised dealer to the ResMed Service Centre within the relevant warranty period referred to above. ResMed will not be responsible for the cost of the transport of your ResMed product to the ResMed service centre. You must pay any necessary costs to the ResMed authorised dealer. All claims under this warranty must be accompanied by your original receipt.
If ResMed determines that your warranty claim is valid we will return the repaired product, or a replacement product, to your ResMed authorised dealer at ResMed’s expense. If ResMed determines that your warranty claim is valid you may claim any reasonable expenses you have incurred in making the claim by posting to us at 1 Elizabeth Macarthur Drive, BELLA VISTA NSW 2153 a claim in writing attaching original receipts for the expenses claimed. If ResMed determines that your warranty claim is not valid we will notify your ResMed authorised dealer by providing a quotation of the cost of repair. Your ResMed authorised dealer will then contact you and you will have the option of taking up the quotation offer, valid for 30 days, or have your product returned unrepaired to your ResMed authorised dealer at ResMed’s expense.
This warranty is void on product sold, or resold, outside the region of original purchase. Warranty claims on defective product must be made by the initial consumer at the point of purchase or to us directly as specified above.
This warranty gives you specific legal rights, and you may also have other rights which vary from region to region. For further information on your warranty rights, contact your local ResMed authorised dealer or ResMed sleepvantage.
If you are provided with a replacement or repaired product, the additional warranty continues to apply to the replacement or repaired device but does not continue beyond the original warranty period referred to previously.
The laws of New South Wales govern these Terms and Conditions.

We will provide you with products and replenishment products in accordance with the therapy plan you selected. Details of the therapy plans are set out at the end of these terms.
Please note, if we stop selling a product available under the plan, we will provide you with a
substitute product.
When you start the therapy plan, you pay an initial instalment fee. Within the first week of sign-up, at your selected day, you will start paying a weekly fee over 36 months (156 weeks). The initial instalment fee and the weekly fee is set out in your therapy plan. We only accept payments via credit card. We will not charge you interest, administration or other fees. If you fail to pay the weekly fees, we will stop supplying you with the products and services until you have paid all outstanding weekly fees. You will own and be able to keep the products you have received under the plan.
If you fail to pay all outstanding weekly fees, we reserve the right to terminate your plan after providing you with a written notice. If we terminate your plan, you will be liable to pay the remainder of the weekly fees under your plan immediately. We may look to recover any other costs and exercise any rights available to us by law. Once the remaining weekly fees are paid in full, you will receive the remaining replenishments that you are entitled to under your therapy plan.
Risk of any loss or damage to products and title to the products will pass to you when you take physical possession of the products or when the products are delivered to you.
We can terminate your plan if you fail to pay the weekly fee. We may allow you to terminate your plan, but you will be liable to pay a cancellation fee calculated as the weekly fee payable multiplied by the number of weeks remaining under your plan.
We will only use your personal information in accordance with the Privacy Act 1988 and ResMed’s privacy notice, found at: https://www.resmed.com.au/privacy-policy Please remember to update your personal information, including your address as soon as possible by emailing us at info@sleepvantage.com.au as we will be delivering the products to the address you provided. We may charge you a delivery fee if the address is incorrect and we have to re-deliver the product..
If you sign up for a ResMed Device Therapy Plan and change your mind, you may cancel your plan within 30 days from the date of sign up. Note: The ResMed Sleep-on-it Promise applies exclusively to ResMed Device Therapy Plans only and you will not be refunded any initial upfront payment fees or subsequent weekly payments made within 30 days from the date of sign up. You will need to contact your ResMed Authorised Dealer or ResMed (whichever you purchased your plan from) to cancel your plan. See terms and conditions below.
You may change your mask within 30 days from the date of sign up or within 30 days of upgrading your mask at no additional cost to you, provided that (a) there is no damage to the mask as a result of improper use; and (b) you have proof of purchase/invoice document. Note: The ResMed Mask Swap Program is limited to one mask swap per customer, per year. Contact your ResMed Authorised Dealer or ResMed (whichever you purchased your plan from) if you would like to take up the ResMed Mask Swap Program. See terms and conditions below.
When you sign-up to the therapy plan, you have the option to become a member of sleepvantage, our membership program. Through sleepvantage you will receive a range of exclusive member benefits. We may also send you marketing and promotional offers. You can opt out from receiving marketing communication at any time by emailing us at info@sleepvantage.com.au or by clicking the unsubscribe button in any email sent to you by us.
Our products come with guarantees that cannot be excluded under Australian consumer law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the products repaired or replaced if the products fail to be acceptable quality and the failure does not amount to a major failure. ResMed provides a limited manufacturer’s warranty. Information on the limited warranty is provided with the products.
These terms are governed by the laws of New South Wales, Australia.
